2017-2018 Proposed Firearm Legislation - State & Federal

Hey all, didn't forget about you. I'm going to have to change the way I post these for you folks this year due to time and budget constraints. I will post each week with what new bills came in that week. Wish I could do more but I'm just not able.

Anyway, here's what has come in so far for the new year, some great bills and some utter nonsense:

Alabama: SB2 would clarify and strengthen preemption laws regarding firearms and ammunition

Arizona: HB2022 excludes rat or snake shot from statutes regarding criminal negligence discharge

California: AB7 would increase the fine for open carrying a firearm

Florida:

S0128 would require prosecutors ot bear the burdon of proof when someone has claimed immunity (self defense)

H6005 would allow open and concealed carry into college or university facility.

S0142 would require all loaded firearms to be locked up or have a trigger lock installed if there are any minors (aged 16 or younger) in the home

S0140 would allow open carry of firearms with a license

H6001 would remove the restriction on carrying firearms in an airport except in secure areas

S0170 would prohibit firearms from sporting arenas and theaters

H0167 is an assault weapon - high capacity magazine ban bill

S0254 is an assault weapon - high capacity magazine ban bill

Georgia:

HB10 is a full blown 'assault weapon' ban along with a large capacity magazine ban and a ban on armor piercing bullets.

HB11 would require anyone wishing to get or renew a carry permit to show proof of firearm training.

Indiana:

SB0013 would allow firearms to be used as security (eg pawn)

SB0043 would remove penal facilities from the list of places where employers can prohibit firearms

SB0050 would require retailers to store tannerite behind a counter and would require them to check the id of anyone buying it to make sure they are at least 18.

SB0078 would allow those that may legally carry a firearm to carry it on school property or churches when attending 'a worship service or religious ceremony'

HB1051 would make it illegal to use state employees or funds in the enforcement of a federal firearms law enacted after January 1, 2017

HB1071 would authorize anyone protected by a civil protection order to carry a firearm without a license for 60 days and would expedite the carry license process for them

HB1095 would outlaw so-called armor piercing ammunition

SB0123 would require anyone applying for license to carry after Dec. 31, 2017 to take an eight hour handgun safety and training program

SB0344 would make possession of a concealed firearm by an illegal alien a class D felony

Kansas: HB2009 would prohibit anyone from carrying concealed firearms at the state capital

Kentucky:

HB101 would allow local governments to regulate firearms

HB108 would exempt all firearms made and kept within the states border exempt from federal law

HB120 would prohibit state or local officials from assisting in any new federal firearm law the states fins unconstitutional

SB28 would require all firearms to be secured with a trigger lock

SB46 would allow 'urban-county governments' and 'consolidated local governments' the authority to regulate firearms

SB7 is a constitutional carry bill with some exceptions

Maryland:

HB53 would make all firearm safety devices tax free

HB59 would allow anyone that owned an 'assault weapon' before the state ban to be able to replace it if it is lost or broken

Michigan:

SB2018 would prohibit realistic looking toy guns

HB312 would authorize hunter safety as part of public school courses

SB2131 would give pistol licenses to retired judges for free

SB2152 would require all ammunition sold in the state to have serial numbers on the casings and would require sellers to keep records and maintain them for 5 years

Missouri:

HB96 would hold business owners that prohibit firearms to be responsible for the safety of patrons and would hold them liable if someone was hurt.

HB241 would outlaw the sale or transfer of firearms to anyone on the terrorist watch list

SB181 would require firearm owners to report lost or stolen firearms within 72 hours of discovery of the loss

SB89 would make it a crime if a child gets hold of an adults firearm

SB152 would require a 24 hour waiting period when purchasing a handgun from a dealer

HB185 would require all lost or stolen firearms to be reported to law enforcement within 72 hours

HB300 would make business owners responsible for the safety of their customers if they post a no guns sign on the property. The business owner would be liable for damages and attorney fees.

HB362 would require all firearms to be secured with a lock or in a safe if there are children under 17 in the home

HB363 is a universal background check bill

HB364 would require anyone wishing to buy a firearm to first get a firearms purchase permit issued by the sheriff's department

HB365 would establish 'extreme risk protection orders' that can be filed with the court by anyone that would require firearms to be seized

HB366 is probably one of the dumbest bills we have ever seen. It would require anyone wishing to purchase a firearm to meet with a physician 72 hours prior to buying a gun to discuss 'physical, psychological, or situational factors, that may arise with the proposed firearm purchase' The bill also states you can not buy a firearm from a dealer that is closer then 120 miles from your home.

HB458 would allow any legal firearm owner to store there firearm in a locked vehicle just about anywhere. It would also provide immunity from civil action to employers that have employees that store firearms in such a way.

Nebraska:

LB81 would raise the cost of handgun fees from $5 to $25

LB68 would preempt local governments from regulating carrying and possession of firearms

LB100 would allow those prohibited persons (due to mental issues) to petition the court to have the prohibition removed

New Hampshire:

SB12 is a constitutional carry bill

HB350 would ban firearms from polling places

New Mexico:

HB50 would require background checks on all firearm sales with very limited exceptions

SB48 would require background checks on all firearm sales with very limited exceptions

SJR5 is a joint resolution recommending the state constitution be changed to make the state a constitutional carry state

SB56 is a constitutional carry bill

HB62 would require a minimum of 60 days notice for expiring carry licenses

HB78 would set up online courses for carry licenses

New York:

S00896 would outlaw phone covers that look like firearms

S00879 is an interesting bill. It appears an upstate legislator is attempting to change all firearm suspension laws to only apply to the counties of Suffolk, Nassau, Kings, Queens, Richmond, New York, Bronx and Westchester, basically telling the city they don't want their stupid laws

S00807 would create a 'sportmans weekend' starting the last Friday in August when certain firearms and sporting goods would be tax free

S00803 would create the offense of illegal gun trafficking for anyone selling stolen or altered firearm and would make it a class D felony

S00739 would allow anyone issued a license for gunsmithing or a dealer in firearms to use that license to carry a firearm anywhere they wish

S00470 would require all new firearms sold to be capable of microstamping

S00451 would require all firearm license to be processed in no more than 180 days

S00437 would require all employees and owners of a firearm dealers to under go background checks (ATF already requires this)

S00432 would require all gun dealers to do massive amounts of work, including locking all firearms in a safe during non-business hours in an attempt to stop illegal gun trafficking

S00354 would only allow purchasing of firearms from businesses that can prove they are 'responsible dealers'

S00353 would require all departments, boards, bureaus, commissions or agencies of the state of New York and local governments to sell their firearms to another law enforcement agency or they are to be sold to an agency that will destroy them

S00320 would require all police officers to report every discharge of their weapon(s) immediately to their superiors no matter when or how the discharge occurred

S00310 would create the crime of 'firing into a crowded space' ... only problem is it only applies to people 18 years old or older

S00202 would make it a crime to sell ammunition to a minor and would require businesses to check ids for the age of the person buying the ammo

S00197 would repeal Section 1. Chapter 1 of the S.A.F.E. act

S00192 would make 25% of the purchase price of firearm safety devices deduct able from income taxes

S00191 would provide a 50% tax credit for the purchase of a gun safe, up to $500

S00135 would allow anyone that has a pistol or revolver license to carry it while attending a pre-license firearms safety course and while under the supervision of the instructor

S00067 would allow police officers to seize firearms and ammunition from any home that they are called to for any domestic call

S00063 would impose additional fees on all firearm sales to establish a gun violence research fund

S00034 would make the possession or sale of armor piercing ammunition a class B felony

S00021 would specify exactly what colors can be used to make 'imitation weapons'

A00349 would require anyone wishing to renew a firearm license to show proof of personal liability insurance

A00224 would make all firearm license information private and immune from freedom of information requests

A00145 would require anyone that is taken to the hospital by police for mental examination to surrender their firearms and would require a 'cooling off' period once they are released before the firearms can be returned

S01050 would authorize game preserves and hunting clubs to sell ammunition for use at there facility

S01193 would restrict the sale of ammunition to only those type a person is allowed to own - makes no sense

S00848 would repeal the large capacity magazine ban enacted under the S.A.F.E. act

S01140 would add siblings, grandparents and grandchildren to the list of immediate family that firearms can be transferred to without a background check

A00456 would outlaw gun shows held in property owner by any government agency

A00457 would make it a crime to store any firearm that is not in a person's immediate possession unless it is locked in a safe or has a trigger lock installed

A00468 would require firearm a safety course be completed and a certificate issued before a firearm license can be issued

A00563 would make it a crime to store any firearm that is not in a person's immediate possession unless it is locked in a safe or has a trigger lock installed

A00800 would outlaw the sale of ammunition to anyone that can not produce a firearm license

A00806 would make the state a 'shall issue' state for non-residents provided they have a license from their home state and can pass a background check

A00878 would allow shooting clubs and preserves to sell ammunition for use on their property without having to register as a seller of ammunition

A00897 would require a hearing prior to revoking a firearm license whenever the director of community services makes a report pursuant to section 9.46 of the mental hygiene law

A00914 is a 'ghost gun' bill

A00980 would require the surrender of firearms for certain misdemeanors

A00986 would exempt active and retired police officers, peace officers and correction officers from disclosure of pistol permits under the freedom of information act

S01320 would limit the sale of ammunition for 'assault weapons' to two times the firearm's capacity every 120 days

S01414 would extend the waiting period for a NICS background check to 10 days before the firearm can be transferred

S01508 would outlaw firearms that 'look like everyday objects'

S01669 would require anyone holding a gun buyback program to check all firearm serial numbers and attempt to find and return any firearm found to be stolen to its rightful owner before destroying it

Oklahoma:

SB5 would drop all fess for carry licenses

SB6 would allow certain government officials to carry firearms anywhere in the state, without a permit, if they take a safety course

SB11 would make changes to carry licenses including dropping the price to $25

Oregon:

SB66 would require the courts to send notifications to the local sheriff and the Oregon Health Authority when someone is found to be mentally defective

SB554 would prevent anyone charged with a felony while using a firearm from pleading to a lesser charge

SB553 would remove state police as the point of contact for background checks and require dealers to use the NICS system

SB552 would change law regarding carrying of firearms so that the state would accept all valid permits from other states

SB549 would exempt honorably retired parole and probation officers from local firearm regulations regarding carrying loaded firearms in public places

SB548 would allow sheriff's to issue permits to any Oregon resident

SB495 would allow county governments to regulation the sales of firearms by pawn shops and second hand stores

HB2592 would provide a 50% tax credit on the purchase of a gun safe up to $250

HB2523 would allow firearm dealers to accept firearms from anyone 'at risk' and would provide a means to return the firearm to the person or another qualified owner. It would also provide immunity to the dealer accepting the firearm

HB2237 would prohibit a firearm dealer from transferring a firearm if state police can not make a determination during a background check

HB2173 would allow anyone hurt in a business that prohibits firearms to sue that establishment

HB2172 would require all businesses to post a sign outside their business regarding their policy with respect to permitting individuals who have a license to carry a concealed handgun to carry a firearm onto the premises

HB2130 would create criminal offenses for adults that leave firearms where children might access them

HB2127 would expand firearm carry reciprocity with other states

HB2126 removes the requirement to maintain firearm sales records by pawnbrokers

South Carolina:

H3183 would make it illegal to sell or transfer a firearm to anyone on the terrorist watch list.

H3330 let school officials allow school personnel and concealed carry permit holders to carry on school property

H3262 would remove the ban on carrying firearms on college or secondary school property

H3252 would outlaw 'green tip ammo' in the state

H3266 would make it illegal to sell or give a firearm to anyone on the terrorist watch list

H3248 would allow people with a concealed carry license to carry firearms on college property

H3328 would require a federal background check be completed before a sale can proceed with an allowable wait period of 28 business days

H3217 would require anyone that has a firearm that is lost or stolen to report it within 24 hours.

H3192 has to be the dumbest thing we have ever seen. It would make it illegal to discharge a firearm in shopping areas or malls, movie theaters, parking lots, or any other public gathering where three or more persons have come together as a group

H3181 would require background checks to be completed, no matter how long they take, before a firearm can be transferred. It would also require background checks at gun shows

H3180 would require all background checks to be completed, no matter how long they take, before a firearm can be transferred.

H3052 would allow public school employees to carry firearms with a special 'school permit

S0085 would allow properly trained school personnel to carry firearms

S0143 would not allow the transfer of a firearm until the federal background check has been completed, no matter how long that takes

S0158 would stop the transfer of a firearm until the federal background check has been completed or 28 days has passed

S0159 would not allow the transfer of a firearm until a federal background has completed or 28 days has passed

S0088 would make business owners that prohibit concealed carry liable for any injuries caused from the perpetrator of a crime

S0021 would allow anyone to use a firearm to kill an animal in self defense

Tennessee: HB0011 would repeal the prohibition on owning suppressors

Utah: HB0112 would eliminate liability for business owners that allow concealed carry in there place of business and it would make it so 21 year old that aren't prohibited could carry without a license

Vermont: S0006 would require background checks on all firearm sales unless the sale is between family

Virginia:

SB187 would require a state issued transfer permit be show in most cases of selling, renting, trading, or transferring a firearm

HB768 would provide for free firearms training courses for victims of domestic violence as well as other offenses

HB1210 would make gun safes that cost less then $1000 tax free

SB178 would make it so only the legislature, not the attorney general, can determine reciprocity with other states

SB865 would make it illegal to give a handgun to a minor with some exceptions

SB809 would require people to report a lost or stolen firearm within 24 hours of finding out about it

SJR229 would create a state lead study to explore a firearms registry

HB1458 would drop the fees for carry licenses so they would be no more than $15

SB915 would require anyone 'in the business' of selling firearms (as a licensed dealer or not) to get background checks on all buyers before they transfer a firearm

SB95 would make the victim of a firearm theft civilly liable for any crime committed with that firearm if the court can show they did not have it secured properly

SB1023 would prohibit state police form sharing concealed carry applicant information with any other state agency

HB1683 would make illegal to carry a shotgun in public

HB1684 would make it illegal to leave a firearm anywhere a child under 14 might get it

HB1685 would create a one gun a month limit on buying handguns

SB1039 would require anyone served with a protective order to submit in writing to the court that they have sold or transferred all their firearms

HB1990 would drop the minimum age for non-residents to 18 for anyone that is active duty

HB1907 would allow schools to employ armed safety officers

HB1879 would deny anyone convicted of public drunkenness within three years prior from getting a carry license

HB1865 would change law regarding the time period required for state police background checks from the end of the next business day to 5 days

HB1864 would restrict the use of firearms by children, even under parental supervision

HB1853 would set up a fund to pay for firearms training for victims of domestic violence

HB1852 would allow anyone who is under the protection of a court order and who is not otherwise prohibited to carry a firearm for 45 days without a permit and would also expedite the permit process

HB1778 would prohibit anyone convicted of a hate crime from owning firearms or getting a carry license for 5 years

HB1773 would require all gun show vendors be registered and require all sales by them to go through a background check

HB1758 would allow firearm seizure warrants to be issued for people who are thought to be a rick to themselves or others

HB1745 would allow prohibited persons to petition the court to have all their firearm rights restored

Washington: HB1004 would remove current law that allows the governor to prohibit carrying firearms during a state of emergency

Wyoming:

HB0090 would allow family members of military personnel stationed within the state to get carry permits

SF0075 would prohibit anyone on the terrorist watch list from buying a firearm or getting a concealed carry license

US Congress:

HB38 is the national reciprocity act of 2017 that would allow anyone from any state, and that had a license to carry a firearm, would be allowed to travel freely into other states.

HB34 would repeal all gun free zones at schools from federal law.

HB57 would require ATF to report to congress the amount of background checks that could not be completed within 3 business days and the transfer went through and then it was found the person was prohibited.

HB62 would require ATF to hire an additional 200 employees to supposedly reduce firearm crimes

A couple of new bills in this week with some real garbage coming from Congress:

OH

HB310 would permit elected officials that have a carry license to carry in government facilities

HB305 would allow those filing protective orders to list any firearms the person being served has. It also would require the transfer of all firearms within 24 hours of being served a protective order if the court decides the offense if prohibiting.

Washington DC

B22-040 would create 'extreme risk' protection orders where persons would be prohibited from owning firearms or ammunition for one year

SB1214 would prevent the EPA from regulation lead ammunition and other sporting good items that are made of lead

SB1505 would remove suppressors from the national firearms act

SB1541 would strike the year 1898 from the definition of an antique firearm and change to to be 100 years prior to the current year

HB3458 doesn't have any text yet but the description states 'To require certain semiautomatic pistols manufactured, imported, or sold by Federal firearms licensees to be capable of microstamping ammunition, and the prohibit the removal, obliteration, or alteration of the microstamped code or microstamping capability of a firearm.'

HB3464 also doesn't have text as of this posting but the description states 'To prohibit firearms dealers from selling a firearm prior to the completion of a background check.'

A couple of new bills this week including some for the Texas special session and one pre-filed for the 2018 Florida session

SB3 would repeal quite a few restrictions on where a firearm can be carried

FL (prefiled for 2018 session) S0120 would make business liable for customer safety if they prohibit carrying firearms

HB123 would make it a defense from prosecution (for carry a firearm on posted property) if the person is asked to leave a does so

HB216 would make the last week of August tax free for firearm and ammunition sales

HB296 is a constitutional carry bill

HB376 would allow a person to shoot a drone down under certain circumstances

SB100 would make firearms and firearm accessories that are made in the state and kept in the state exempt from federal regulations

HB13 would make straw purchases illegal, they already are under federal law

CA

AJR24 is a resolution asking congress to not pass national reciprocity

FL

S0148 would loosen restrictions and penalties for 'accidental' open carry

H0039 lessens the penalties for 'accidentally' exposing a concealed firearm but we honestly think they just need to stop screwing around and legalize open carry

S0218 would basically require anyone with kids to keep their firearms locked up at all times

H0113 would allow concealed carry on school property if a 'religious institution' is located on it

S0240 would clarify law regarding carrying firearms on private school property by stating the law does not apply to concealed permit holders

SB2229 would remove the requirement to have a firearm owner id card to legally possess a switchblade knife

SB2231 would ban concealed carry in churches and on church property

MI

SB0527 is a reaction to the grandfather that was denied custody of a foster child because he owned guns. That being said it does have some strong restrictions.

HB4955 would prevent adoption agencies from taking into9 consideration any ownership of firearms by the potential adopters

OH

SB180 would strengthen stand your grand laws, assign the burden of proof for self-defense cases to the prosecutor and modifies penalties for illegally carrying a concealed firearm or improperly handling firearms in a motor vehicle

PA

HB1709 would require anyone that owns or wants to buy a firearm get training and be issued a certificate by the state police

HB1771 would set up a taxpayer funding statewide gun buyback program

WI

SB402 would add several more exceptions to current law for possession of a firearm on school property

SB408 is another silly bill to make straw purchases more illegal than they already are

HB3613 would set up federal grants to states and gun dealers to hold gun buyback programs

HB3668 is a sportsman's bill that now contains the language to remove suppressors from the NFA registry

HB3790 would increase penalties for the theft of firearms from a gun dealer or a shooting range

B22-0514 would set up a means of relief from firearms restrictions for those who have had mental health issues but have recovered

AB524 is an attempt to strengthen straw purchase laws but has some very strange language about an affirmative defense for the defendant

GOAL has learned that the MA House of Representatives engrossed a new budget bill during informal session today, which includes the Linsky amendment regarding modification of firearms.

The language is in two parts.

The first section (Section Eighteen), copied below, would make any basic modification and or maintenance of a firearm illegal, including required maintenance like lubrication of moving parts.

Section 131R. Whoever possesses, owns or offers for sale any device which attaches to a rifle, shotgun or firearm, except a magazine, that is designed to increase the rate of discharge of the rifle, shotgun or firearm or whoever modifies any rifle, shotgun or firearm with the intent to increase its rate of discharge, shall be punished by imprisonment in the state prison by not less than 3 nor more than 20 years.

The second section (Section 51) is equally egregious in that it gives EOPPS regulatory authority over all maintenance and enhancement of rifles, shotguns, and firearms. Can you imagine what AG Healey would do should EOPPS be granted this kind of authority? See language pasted below.

The Secretary of Public Safety shall promulgate regulations by January 1, 2018 concerning the allowability of maintenance and enhancement of rifles, shotguns and firearms consistent with the intent of this section.

We are being told that Governor Baker will sign this into law, by Tuesday, October 31, 2017. Please take action immediately

Please call your state representative and senator immediately! Let them know that this amendment must be stripped from the budget bill. This language is so broad and open to interpretation and abuse that it will cause a legal quagmire for licensed gun owners in Massachusetts.

A BILL
To amend title 18, United States Code, to limit the authority of States and localities to regulate conduct, or impose penalties or taxes, in relation to rifles or shotguns.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.

This Act may be cited as the “Second Amendment Guarantee Act” or the “SAGA Act” .

SEC. 2. LIMITATION ON AUTHORITY OF STATES AND LOCALITIES TO REGULATE CONDUCT IN RELATION TO RIFLES OR SHOTGUNS.

Section 927 of title 18, United States Code, is amended—

(1) by striking “No” and inserting “(a) Except as provided in subsection (b), no”; and

(2) by adding after and below the end the following:

“(b) (1) A State or a political subdivision of a State may not impose any regulation, prohibition, or registration or licensing requirement with respect to the design, manufacture, importation, sale, transfer, possession, or marking of a rifle or shotgun that has moved in, or any such conduct that affects, interstate or foreign commerce, that is more restrictive, or impose any penalty, tax, fee, or charge with respect to such a rifle or shotgun or such conduct, in an amount greater, than is provided under Federal law. To the extent that a law of a State or political subdivision of a State, whether enacted before, on, or after the date of the enactment of this subsection, violates the preceding sentence, the law shall have no force or effect. For purposes of this subsection, the term ‘rifle or shotgun’ includes any part of a rifle or shotgun, any detachable magazine or ammunition feeding device, and any type of pistol grip or stock design.

“(2) In an action brought for damages or relief from a violation of paragraph (1), the court shall award the prevailing plaintiff a reasonable attorney’s fee in addition to any other damages or relief awarded.”.

• H.1281 – An Act Closing the Assault Weapon Magazine Loophole, filed by Rep. Linsky, this legislation would make all magazines that hold more than ten rounds illegal to possess in MA.
• H.2495 – An Act to require liability insurance for gun ownership, filed by Rep. Linsky, this legislation would criminalize firearms ownership in MA with a penalty of up to one year in prison for not having insurance. It will also give the state authority over the insurance requirements.
• H.3610 – An Act relative to firearms and firearms violence – This is another version of the “Extreme Risk Protection Order” bill that we have covered before – the legislation would enable stripping of civil rights without due process.
• S.1298 – An Act relative to firearms and firearms violence – filed by Senator Creem. This bill will ad an additional tax to firearm and ammunition sales as a means of funding violence prevention initiatives.

Oh man please let HB1865 Pass. As for the other 2 bills, I'm not surprised they were proposed by some bloody twit from St Louis. With few exceptions most of the anitgun stupidity seems to emenate from that part of the state

Virginia is getting wacky fast. The out going State Administration really tried to pull some fast ones. Those efforts ultimately back fired due to a majority of the state reps being red. The incoming State Administration is worse and have already announced "common sense" weapons laws they intend to push. This is gonna be ugly as the states red reps have the majority by one seat. So much for the state who's motto is "Sic Semper Tyrannis". The area I live in is deep blue despite a lot of defense contractors and a high mil population. I've sent emails to all my reps, only one is worthwhile but best to let the others know some voters are watching. One the fun side, here is what the our Out going Governor said today.
